Service Description: In Maryland, a marina is defined by COMAR 08.04.06.01 as "a facility for the mooring, docking, or storing of more than ten vessels on tidal navigable waters including a commercial, noncommercial, or community facility." The Maryland Department of the Environment restricts shellfish harvest in waters adjacent to marina facilities between May 1st and September 30th. Restrictions are based on the number of slips the marina has as follows: Marinas with10-50 slips require a100 foot buffer, marinas with 51-100 slips require a150 foot buffer, and marinas with greater than 100 slips require a 200 foot buffer. These restricted areas are established as part of Maryland's participation in the National Shellfish Sanitation Program. Under this program, these areas, while not necessarily containing polluted water or shellstock, are restricted as a precautionary measure to assure that only safe, marketable shellstock will be harvested.
